Acadia Center Files Brief in FERC Docket ER26-2389 re NE Transmission Owners Request for 11.39% ROE

Acadia Center filed the attached Brief with Supporting Exhibits in the FERC docket devoted to the New England Transmission Owners' (NETOs) request to revise the ISO New England Open Access Transmission Tariff (OATT) to increase the base ROE on transmission investments to 11.39% (ER26-2389). This is a proceeding under Section 205 of the Federal Power Act, and so NETOs bear the burden of proving that their proposed ROE is just and reasonable. The Brief argues – based on testimony provided by Phil Hanser – that the NETOs failed to meet that burden, and that their proposed 11.39% ROE is thus unjust, unreasonable, and unlawful.
